These Terms of Service and End User License Agreement (collectively, the “Agreement”) constitute a legally binding agreement between you (“you,” “your,” or “user”) and Hexiqon Information Limited (“Company,” “we,” “us,” or “our”) regarding your access to and use of our mobile applications, websites, and related services (collectively, the “Services”).
Our Services provide AI-powered garden and outdoor space design, enabling users to upload images of outdoor spaces and generate AI-assisted design visualizations.
Please read this Agreement carefully before downloading, installing, accessing, or using the Services.
By downloading, installing, accessing, or using the Services, you acknowledge that you have read, understood, and agreed to be bound by this Agreement. If you do not agree to this Agreement, you must not access or use the Services and must delete the App from your device.
We may update or modify this Agreement from time to time at our sole discretion.
When we make changes, we will update the “Last Updated” date above. Your continued use of the Services after any changes means that you accept the updated Agreement.
You must be at least 13 years old to use the Services.
If you are under the age of majority in your jurisdiction, you may use the Services only with the consent and supervision of a parent or legal guardian.
By using the Services, you represent that you have the legal capacity to enter into this Agreement.
The Services are designed to help users generate AI-powered visual concepts for gardens, yards, patios, landscaping, and other outdoor spaces.
The Services may allow users to:
Upload images of outdoor areas
Enter design preferences or prompts
Generate AI-assisted outdoor design results
Save or share generated outputs
The Services are provided for personal, non-commercial use unless otherwise expressly authorized by us.
The Services may generate images, suggestions, or design concepts using artificial intelligence.
You acknowledge and agree that:
AI-generated outputs are for visualization and inspiration purposes only
Outputs may not be accurate, complete, practical, or suitable for real-world construction
The Services do not provide architectural, engineering, landscaping, legal, safety, or professional advice
You are solely responsible for verifying any design idea before implementation
You should consult qualified professionals before making physical changes to your property
We do not guarantee that AI-generated outputs will meet your expectations or be error-free.
You may upload images, prompts, text, preferences, or other materials to the Services (“User Content”).
You retain ownership of your User Content. However, by using the Services, you grant us a limited, worldwide, non-exclusive, royalty-free license to process your User Content solely for the purpose of:
Providing the Services
Generating AI design outputs
Maintaining and improving service functionality
Ensuring security and preventing misuse
You represent and warrant that you have all necessary rights to upload and use the User Content.
You agree not to upload content that:
Violates any law or regulation
Infringes intellectual property rights
Contains private or sensitive information of others without permission
Is abusive, harmful, misleading, or unlawful
Contains malware, harmful code, or attempts to disrupt the Services

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, access, and use the Services for personal, non-commercial purposes.
This license does not transfer any ownership rights to you.
The Services, including but not limited to software, source code, interface, design, graphics, logos, trademarks, text, features, and functionality, are owned by Hexiqon Information Limited or its licensors.
You may not copy, reproduce, distribute, modify, reverse engineer, decompile, disassemble, sell, lease, sublicense, or create derivative works based on the Services unless expressly permitted by law or by us in writing.
All rights not expressly granted are reserved.
You agree not to:
Use the Services for unlawful, harmful, fraudulent, or abusive purposes
Upload content that infringes the rights of others
Reverse engineer, copy, or modify the App
Interfere with or disrupt the operation of the Services
Attempt to gain unauthorized access to our systems
Use automated tools, bots, scraping, or similar methods without permission
Use the Services to generate or distribute misleading, illegal, or harmful content
Resell, rent, sublicense, or commercially exploit the Services without authorization
We may suspend or terminate access if we believe you have violated this Agreement.
The Services may include or rely on third-party services, such as cloud hosting, analytics, platform services, or other technical service providers.
We are not responsible for third-party services, websites, content, or practices. Your use of third-party services may be subject to their own terms and privacy policies.
We may update, modify, suspend, or discontinue any part of the Services at any time.
We do not guarantee that the Services will be available, uninterrupted, secure, or error-free.
The App may require compatible devices, operating systems, internet access, and periodic updates.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RELIABILITY.
WE DO NOT WARRANT THAT:
THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE
AI-GENERATED OUTPUTS WILL BE ACCURATE OR SUITABLE FOR YOUR PURPOSES
DEFECTS WILL BE CORRECTED
THE SERVICES WILL BE FREE OF VIRUSES OR HARMFUL COMPONENTS
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEXIQON INFORMATION LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY.
WE SHALL NOT BE LIABLE FOR DAMAGES ARISING FROM:
YOUR USE OR INABILITY TO USE THE SERVICES
AI-GENERATED OUTPUTS OR DESIGN DECISIONS BASED ON THEM
UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA
THIRD-PARTY SERVICES OR CONTENT
PROPERTY MODIFICATIONS OR REAL-WORLD IMPLEMENTATION OF DESIGN IDEAS
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
If you download the App from the Apple App Store, you acknowledge and agree that:
This Agreement is between you and Hexiqon Information Limited, not Apple
Apple is not responsible for the App or its content
Apple has no obligation to provide maintenance or support services for the App
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if applicable
Apple is not responsible for any claims relating to the App or your use of it
Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you
You must also comply with the Apple Media Services Terms and Conditions.
You represent and warrant that:
You are not located in a country subject to a U.S. Government embargo
You are not located in a country designated by the U.S. Government as a “terrorist supporting” country
You are not listed on any U.S. Government list of prohibited or restricted parties
We may suspend or terminate your access to the Services at any time if you violate this Agreement or if we reasonably believe your use may cause harm to us, other users, or third parties.
Upon termination:
Your right to use the Services will immediately cease
You must stop using the Services
Any provisions intended to survive termination will remain in effect
This Agreement shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to conflict of law principles.
Any dispute arising out of or relating to this Agreement or the Services shall be submitted to the competent courts located in New York, New York, unless otherwise required by applicable law.
Before filing a claim, you agree to contact us first and attempt to resolve the dispute informally.

To the extent permitted by law, you agree to bring claims only in your individual capacity and not as part of a class action or representative proceeding.

You may not assign or transfer this Agreement without our prior written consent.
We may assign or transfer this Agreement in connection with a merger, acquisition, sale of assets, corporate reorganization, or by operation of law.
